2008 Magic Half Million Dollar Song of the Day Official Rules

1. How to Enter the Contest:

1. The Magic’s Half Million Dollar Song of the Day contest will begin on Thursday, May 1st, 2008 and end on Wednesday, June 18th, 2008.

1. To participate in the contest, through KMJK, Cumulus Media, 5800 Foxridge Drive, Suite 600, Mission, KS 66202.  Listeners can register for the contest by listening for the signal to call and being the 7th caller.  The 7th caller must correctly identify the song title of that day’s “Magic Song Of The Day.”  The listener who is the 7th correct caller to get through to the station will win $107 dollars on Mondays, Tuesdays, and Wednesdays, Fridays.  Correct callers will receive $1000 dollars on Thursdays.  Winners will receive a prize of $107 dollars Mondays, Tuesdays, and Wednesdays, Fridays.  Winners will receive a prize of $1000 dollars on Thursdays.

1. The total number of qualifiers invited to the final grand prize event.  Registration for the grand prize drawing will occur from 7pm to 7:45pm.  No check-in/registration after 7:45pm will be eligible for the grand prize event.  Each qualifier will be eligible for a drawing that will allow each person to select a five digit code.  Contestants will be called up by name to enter the five digit code of their choice one.  If the five digit code does not open up the half million dollar case they qualifiers will then have the opportunity to enter their name in the $10,000 drawing.  One winner will be drawn for the $10,000 prize if the half million dollar case does not open.

1. Limit one (1) entry per person.  Entrants may be disqualified at the sole discretion of KMJK.

1. Eligibility Restrictions:

1. The contest is open to all KMJK, Magic 107.3 listeners who are 21 years of age or older and who reside in Kansas City Metro. Employees, officers, and directors of KMJK, Cumulus Media, and Odds On Promotions, their respective affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, and promotion agencies, any and all other companies associated with this contest, and the members of the immediate families or households of any of the above are not eligible. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household.

1. Listeners are eligible to win a KMJK contest only once every per six-month period unless otherwise specifically stated.  An individual may win other seasonal or one-time contests only once for the duration of the contest.  Only one (1) winner per household is permitted in any contest.

1. Prizes:

1. Grand Prize: USD: $500,000. A maximum of one (1) grand prize will be awarded. If the one (1) available Grand Prize is won in accordance with these Rules, the contest will officially end at the time the Grand Prize is won.

1. Grand prize is provided courtesy of Odds On Promotions.

1. A maximum of one (1) second place prize will be awarded. If the one (1) available Grand Prize is won in accordance with these Rules, the contest will officially end at the time the Grand Prize is won and no second place prize will be awarded.  All contestants will be called up by name to enter the five digit code of their choice one and enter their name in the second place drawing for $10,000 which will be awarded at the end.

1. All prizes or prize certificates may be picked up at the office of KMJK.  Any prize or prize certificate not claimed within forty-five days of winning will be forfeited by the winner.  In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its arrival.  KMJK is not responsible for the safe arrival of a prize or prize certificate.

1. Contest prizes are not transferable. Prizes may not be substituted for or redeemed for cash.

1. Grand Prize winner will receive 1099 IRS Tax form for the value of the grand prize as stated in these contest rules.

1. Prizes are limited solely to those items explicitly set forth herein and shall not include any and all other expenses, incidentals or taxes that may arise out of the winner’s receipt of this prize.

1. Selection and Notification of Winners:

1. Decisions of KMJK, Cumulus Media management with respect to the contest are final.

1. After completing the registration information, the contestant may then enter their five (5) digit number code into the keypad on the prize vault.

1. In order for a Grand Prize to be awarded, the code entered by the contestant into the keypad must exactly match the predetermined winning code selected for this contest by Odds On Promotions that is contained in the sealed security master envelope.

1. The act of displaying the grand prize winning message to the prize vault does not constitute a winning attempt.  In order to be considered a winning attempt:

1. Triggering the grand prize winning message only by means of entering that five (5) digit code into the locking mechanism; AND
2. The contestant’s code must exactly match the predetermined winning code selected by the insurance provider that is contained in the sealed master security envelope, and that was preprogrammed by Odds On Promotions into the electronic keypad.

1. The grand prize will NOT be awarded as a result of any of the following reasons including, but not limited to:
1. Any code entered into the keypad that does not match the predetermined winning code contained in the sealed security master envelope, and programmed by Odds On Promotions.

1. The odds of being selected as an official contestant(s) are dependent upon the number of entries received.

1. Conditions:

1. Payment of all federal, state and local taxes are the sole responsibility of the winner.  Winners will be required to sign an IRS Form W-9 or the equivalent.  Failure or refusal to execute the release will result in winner forfeiting the prize.  Photo identification and social security number of the Grand Prize winner may also be required in order to collect the prize

1. By participating in the contest, the winner or winners (and their guest or traveling companion, if any) agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.

1. A maximum (1) grand prize(s) will be awarded.  Grand prize winner must accept delivery of prize from sponsor, or as otherwise instructed by sponsor.  All other costs related to prize delivery and acceptance is the responsibility of winner including but not limited to all federal state and local taxes.  All properly claimed prizes will be awarded.  Prizes are non-transferable and no cash redemption or prize substitution allowed, except at sponsor’s sole discretion or as provided herein.  Sponsor reserves the right to substitute a prize of equal or greater value if an advertised prize becomes unavailable.

1. Grand prize winner(s) will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release (Tennessee residents need not sign publicity release), and present a valid driver’s license and social security card before prize will be awarded.  Winners of prizes greater than $600.00 will be issued a 1099 form reflecting the value of the prize(s) and are responsible for paying all income taxes on prize(s).  Pursuant to the liability release, the winners will agree to hold Odds On Promotions, KMJK, its licensee, their affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

1. KMJK, Cumulus Media reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason.  Material modifications shall be announced on-air, when practical. By participating in this contest, you agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by KMJK, Cumulus Media management.

1. No purchase is necessary.  Purchase does not increase chances of winning. The contest is void where prohibited.

1. Failure to comply with the contest rules may result in a contestant's disqualification, at the sole discretion of KMJK, Cumulus Media.

1. KMJK, Cumulus Media is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.

1. Copies of the written contest rules and a list of all winners are available during regular business hours at the main studio of KMJK, Cumulus Media, 5800 Foxridge Drive, Suite 600, Mission, KS 66202 or by sending a self-addressed stamped envelope to KMJK, Cumulus Media.

1. Miscellaneous:

1. State issued identification must be presented to claim prize.  Winners will be required to fill out a prize fulfillment package.

1. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of Cumulus Media Partners, their affiliates and sponsors to be used, disposed of or destroyed at the discretion Cumulus Media Partners, their affiliates and sponsors.

1. All winners agree that Cumulus Media Partners, their affiliates and sponsors may broadcast or publish their name, city of residence, photo, video tape, film or any other likeness, including their voice, recorded or live, for any reason Cumulus Media Partners, their affiliates and sponsors deems necessary without compensation.  All winners will be further required to hold Cumulus Media Partners, their affiliates and sponsors, blameless and without liability for such publication, broadcast or use.

1. KMJK reserves the right to end a contest at any time upon advanced notice to the public

1. KMJK reserves the right to limit the number of times an individual may enter a contest or drawing.

1. KMJK reserves the right to require contestants to be present at drawings in order to win their prize.

1. KMJK reserves the right to require contestants or their representative via written proxy to be present at drawings in order to win their prize.

1. KMJK and Cumulus Media Partners reserve the right to change any of this promotion and/or the promotional elements.  Odds of winning are based on the number of entries received.

1. Violations of any of these rules or attempts to win any contest by fraud, deception, or cheating shall be grounds for the station to disqualify that individual from participating in all current and future contests and events at the sole discretion of the station, as well as forfeiture of any prize or prizes won by fraudulent means.

1. Winners must come in to the Cumulus Radio Kansas City office in mission Kansas and present valid legal state issue ID and fill out a winner verification form. Winner will be notified when checks are returned from our home office. This process takes 4 to 8 weeks and will have ten days from notification to claim prize.
